  • Fill out the "ARBITRATOR STATEMENT OF DISCLOSURE" and return the form to the bar association within 5 business days of the date of the assignment letter.
  • IF YOU ARE UNABLE TO ACT AS AN ARBITRATOR BECAUSE OF A CONFLICT, PLEASE CALL THE CONTRA COSTA COUNTY BAR ASSOCIATION IMMEDIATELY AND RETURN THE COMPLETE FILE TO THIS OFFICE.
  • Upon receipt of the "Disclosure" the parties will be sent "Notice of Appointment of Panel". A copy will also be sent to you.
  • When you receive the "Notice" you should contact the complainant and attorney and schedule the arbitration hearing within 45 days for a single arbitrator and 90 days for a three-member panel from the date of service of the "Notice".
  • We would prefer, if possible, that you hold the arbitration in one of the conference rooms at the Bar Association office in Concord.
  • If you wish, you may use the "Request for Arbitration Hearing Dates" form to contact all the parties involved first and arrange a list of SEVERAL dates and times that are amenable to the schedules of all involved.
  • THEN CALL THE BAR ASSOCIATION TO CHECK OUR CALENDAR and schedule the arbitration.
  • THE "NOTIFICATION OF HEARING DATE" FORM MUST BE COMPLETED AND SERVED ON EACH PARTY WITHIN 10 DAYS OF YOUR APPOINTMENT AND AT LEAST 15 DAYS PRIOR TO THE HEARING DATE.
  • A copy of the "Notification" should also be sent to the Fee Arbitration Coordinator at the Bar Association.
  • Once a date has been selected that meets the satisfaction of all parties, continuances should not be granted except for good cause and when sought in a timely fashion.
  • Such continuances, if granted, should be noticed to the Bar Association at all times.
  • At the time of the hearing, if the parties have not previously agreed that the arbitration be binding, please pursue making the arbitration binding.
  • If either party wishes to submit documents, they must be submitted to both the opposing party and the arbitrator at least one week prior to the scheduled hearing date. This notice is included on the "Notification of Hearing Date" form. It is within the arbitrator's discretion whether or not to accept non-complying documents.
  • Awards must be submitted to the Program within 15 days of the close of the hearing in any matter heard by a sole arbitrator and within 25 days of the close of the hearing in any matter heard by a three-member panel.. Refer to the "Fee Arbitration Handbook" for instructions and format.
  • Send the original of the Award and the signed binding agreement if they had not previously agreed to binding to the Bar Association. We will serve the award.
