Mediation Research: What We Know About What Works

Attorneys have been taking their clients to mediation for many years now. Lots of cases settle and a lot don’t. Lawyers have ideas about why to choose one mediator or another. Mediators have ideas about what they do and why it works when it does. But, do we really know? Surprisingly, we may not really have much good empirical information on what works. Some new research seems to say that even the mediators don’t really know. And the lawyers, well, we’ll talk about that, too.
This program will explain what we know from empirical research. No polemics. No pitch for “facilitative” or “evaluative” mediation styles. Just the closest we can get to the facts.
Gary Weiner will take you through the research that really answers these questions:
• What works?
• What mediator behaviors are more highly correlated with resolution?
• Do “pressure tactics” work?
• Do we really have to meet with the other parties in joint session if we want to settle our case?
• What things do parties and attorneys do that are most highly correlated with settlement?
• How should we really prepare for mediation?
